Terms of Service

These Terms of Service (“Terms”) govern your use of h2onu.com and any related H2ONU services (collectively, the “Service”), operated by Ray Culver, an individual proprietor (“we,” “us,” or “H2ONU”). By using the Service you agree to these Terms.

Eligibility

You must be at least 18 years old to make a purchase, or have the consent of a parent or guardian. By using the Service you represent that you meet this requirement.

Your account

You're responsible for keeping your login credentials secure and for everything that happens under your account. Tell us right away at support@h2onu.com if you suspect unauthorized access.

Orders & payment

• All orders are subject to acceptance and availability. We may decline or cancel any order at our discretion (e.g. suspected fraud, pricing error, out-of-stock).
• Prices are in U.S. dollars. We may change prices at any time, but changes won't affect orders already accepted.
• Payment is processed by Stripe. By providing payment information you authorize us to charge your selected payment method for the total amount.
• Sales tax is collected where required by law.

Shipping, returns, refunds

See our Shipping & Returns policy for full details on fulfillment, delivery estimates, and the return window for physical merchandise. Books and apparel are made to order via print-on-demand and are non-returnable unless damaged or defective.

Intellectual property

H2ONU, the H2ONU title and cover, all artwork, photography, and book content are © Ray Culver and protected by U.S. and international copyright. You may not reproduce, distribute, scan, or create derivative works from any H2ONU content without our written permission.

The H2ONU honu mark and related logos are trademarks of Ray Culver. Limited fair use (reviews, criticism, commentary) is permitted under applicable law.

User content

If you send us reviews, feedback, comments, or other content (e.g. by email, social tag, or future on-site forms), you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, and share that content in connection with the Service, including marketing. You're responsible for the legality and accuracy of anything you send us.

Prohibited use

You agree not to:

• Reverse-engineer, scrape, or attempt to access non-public areas.
• Disrupt the Service, send malware, or attempt unauthorized access to any account.
• Impersonate any person or misrepresent your affiliation.
• Use the Service for any unlawful purpose.

Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or secure.

H2ONU is a work of fiction. Any resemblance to actual events, real persons, organizations, or theological claims is for narrative purposes only and not statements of fact.

Limitation of liability

To the maximum extent permitted by law, in no event will H2ONU, Ray Culver, or any agents be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the Service. Our total cumulative liability for any claim arising out of these Terms is limited to the amount you paid us in the twelve (12) months before the claim, or $100, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless H2ONU and Ray Culver from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Service.

Governing law & venue

These Terms are governed by the laws of the State of Hawai'i, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Honolulu, Hawai'i, and you consent to that jurisdiction.

Changes

We may update these Terms from time to time. We'll post the revised version with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance.
