Affiliate Program Terms

These Affiliate Program Terms (“Terms”) govern your participation in the H2ONU Affiliate Program (the “Program”), operated by Ray Culver, an individual proprietor (“we,” “us,” or “H2ONU”). By checking the acceptance box on the affiliate application, or by participating in the Program, you agree to these Terms and to our Terms of Service.

Eligibility & application

• You must be at least 18 and able to enter a binding contract.
• Participation begins with an application at h2onu.com/affiliate. We review every application by hand; approval is at our sole discretion, and we may decline or later remove any partner.
• One account per person or entity. Your account and tracking link are personal to you — don't share, resell, or transfer them.

Your link & how attribution works

• On approval you receive a private tracking link. When someone follows it, we set a first-party cookie in their browser.
• Attribution is last-click, 30-day: a sale is credited to the most recent affiliate link the buyer followed within 30 days before purchase.
• A qualified sale is one that is approved, paid, and past our return window. Orders that are refunded, charged back, canceled, or flagged as fraudulent are not qualified — any commission already recorded for such an order is reversed from your balance.
• Purchases you make through your own link do not earn commission.

Commission

Affiliates earn on a permanent, climbing ladder tied to your count of qualified sales:

• From your first sale — 15%
• 10+ qualified sales — 18%
• 25+ — 20%
• 50+ — 22%
• 100+ — 25% (cap)

The ladder is permanent but not retroactive: each sale earns the rate you had unlocked at the time of that sale, and your rate never drops. Founding partners — the first 20 approved partners — lock a 20% floor from their first sale and still climb to 25%. Commission is a percentage of the product price of the qualifying item. Any individually negotiated rate acts only as a floor and is honored where higher.

Payouts

• Commissions are paid by Venmo, on request from your partner console.
• You can request a payout once your cleared balance (approved commissions past the return window) reaches the $20 minimum.
• Payouts are sent manually, typically within a few days of your request, and are logged in your console ledger.
• We may hold or delay a payout while we review suspected fraud, policy violations, or an unusual pattern of returns.

Taxes

US partners: a completed IRS Form W-9 is required before your first payout — email it to press@h2onu.com. If your earnings reach $600 in a calendar year, we will issue a 1099-NEC as required by law. Non-US partners are responsible for reporting and paying any taxes owed in their jurisdiction. You participate as an independent contractor, not an employee or agent of H2ONU, and nothing here creates an employment relationship, joint venture, or partnership.

Required disclosures

You must clearly and conspicuously disclose your paid relationship with H2ONU on every promotion, in a way a reasonable person would notice — for example #ad or “H2ONU partner.” This is a legal requirement under the U.S. Federal Trade Commission's endorsement guidelines, not just a courtesy. Failure to disclose is grounds for removal from the Program.

How you may promote

• Be yourself. Post from your own voice and accounts. Do not impersonate H2ONU or imply you speak for us.
• Be accurate. Represent the book truthfully. Use the supplied creative and approved messaging; don't fabricate claims, reviews, or endorsements.
• The price holds. The First Edition is $79.99 everywhere — you may not advertise or imply a discount on the book. Where offered, free-shipping codes are the only permitted incentive.
• Stay in bounds. No spam, misleading subject lines, or clickbait, and no promotion in adult, hateful, violent, or otherwise unlawful or brand-damaging contexts.

Prohibited conduct

• Self-dealing (earning commission on your own or coordinated purchases), cookie-stuffing, or any manipulation of tracking.
• Misrepresenting the book, its price, its availability, or your relationship with H2ONU.
• Unauthorized use of the H2ONU name, cover, artwork, or trademarks beyond the supplied Partner Kit and approved messaging.
• Bidding on or registering H2ONU brand terms or look-alike domains to intercept our traffic.

Term & termination

Either party may end participation at any time, for any reason. On termination, approved commissions above the payout minimum are paid; pending or unqualified commissions are void. We may withhold unpaid commissions and terminate immediately for fraud, disclosure failures, or material violations of these Terms.

Changes to the Program

We may modify commission rates, the founding window, or these Terms on a going-forward basis; commissions already earned are not reduced retroactively. Material changes will be noticed by email, and continued participation after a change means you accept it.

Disclaimers

The Program is provided “as is” and “as available.” To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee any level of sales, earnings, traffic, or that the Program or its tracking will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, in no event will H2ONU, Ray Culver, or any agents be liable for any indirect, incidental, consequential, special, or punitive damages arising out of the Program. Our total cumulative liability for any claim arising out of these Terms is limited to the total commissions owed to you in the twelve (12) months before the claim, or $100, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless H2ONU and Ray Culver from any claim, loss, or expense (including reasonable attorneys' fees) arising from your promotions, your failure to disclose, or your breach of these Terms.

Governing law & venue

These Terms are governed by the laws of the State of Hawai'i, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Honolulu, Hawai'i, and you consent to that jurisdiction.
